DELLTM DRIVEN TO SUCCEED CONTEST
OFFICIAL RULES AND REGULATIONS THIS CONTEST IS INTENDED FOR RESIDENTS OF CANADA (EXCLUDING QUEBEC) ONLY AND WILL BE INTERPRETED ACCORDING TO ONTARIO LAW. 1. The contest sponsors are CTVglobemedia Publishing Inc. and Dell Canada Inc. (“Contest Sponsors”). 2. NO PURCHASE NECESSARY. To enter and to be eligible to win, entrant must be a legal resident of Canada (excluding Quebec) and be over the age of majority in the province or territory in which he/she resides. Employees and their parents, siblings and children, and persons domiciled with an employee of any of the Contest Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. A winner of a contest sponsored in whole or in part by any of the Contest Sponsors, within the three (3) months preceding the start of this contest (including persons designated by such winners to take ownership of prizes) and persons domiciled with such winner are also not eligible to enter. 3. TO ENTER the DELL DRIVEN TO SUCCEED contest (the “Contest”), simply visit the web site located at www.globeandmail.com/fuelyourbiz, click on the Contest page, complete and submit your entry by following the instructions found on the site. You can also submit one additional entry each week by fully completing a weekly optional survey, up to 5 questions. All entries must include your first and last name, address, email address and ten digit day time and evening telephone number. Limit of one (1) entry per individual per email address, per household, per week.] 4. Contest starts at 12:00:01 a.m. Eastern Time ("ET") on Tuesday, October 14, 2008 and closes on Tuesday, November 25, 2008 at 11:59:59 p.m. ET (the “Contest Period”). For the purpose of this Contest, a week will run from Tuesday at 12:00:01 a.m. ET until the immediately following Monday at 11:59:59 p.m. ET, except that the last week of the Contest shall run from Tuesday, November 18, 2008 at 12:00:01 a.m. ET until Tuesday, November 25, 2008 at 11:59:59 p.m. ET. Void where prohibited. 5. "Grand Prize - There is one (1) Prize consisting of Petro-Canada Preloaded Gas Cards valued at $5,000. Approximate retail value of the Prize is Five Thousand Dollars ($5,000.00) Cdn. Prize is redeemable only at participating Petro-Canada retail outlets. 6. Prize must be accepted as awarded. The Prize is non-exchangeable, non-transferable, non-refundable, has no cash surrender value and must be accepted as awarded without substitution, except at Contest Sponsors’ sole discretion as provided herein. Contest Sponsors reserve the right to substitute the Prize for one of approximately equal value. In no event shall Contest Sponsors be responsible for more than the number of prizes set out in these Official Rules. Prize winner is solely responsible for all costs not expressly described herein. 7. On or after Thursday, November 27, 2008 at approximately 2:00 p.m. ET , a random draw for the Prize will take place at Black and Company, Toronto, Ontario from among all eligible entries received during the Contest Period. The first entry drawn will be eligible to win the Prize. The odds of winning a Prize will depend upon the total number of eligible entries received during the Contest Period. Black and Company, acting reasonably, will attempt to contact the selected entrant/potential winner by telephone within two (2) business days after the draw. In order to be declared a winner and awarded the Prize, potential winner must: (i) first correctly answer, unaided, a time limited mathematical skill testing question administered by Black and Company; and (ii)sign and return within the time stipulated by the Contest Sponsors, a full declaration, release and indemnity form stating that he/she has read and understood these Official Rules, grants all consents required, authorizes the Contest Sponsors to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner (beyond the awarding of or participation in the Prize), accepts the Prize as offered and releases the Contest Sponsors from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. If a selected entrant: (i) fails to abide by these Official Rules; (ii) cannot be contacted within two (2) business days after the first reasonable attempt; (iii) is unable to correctly answer the skill-testing question; (iv) fails to sign and return the required documents within the required time period; or (v) cannot take delivery of a prize for any reason, the selected entrant is disqualified and forfeits his/her prize with no liability of Contest Sponsors. In the event that a selected entrant is disqualified for any reason, another valid entry will be drawn. Proof of identification must be provided upon request. The provisions and procedures referred to above relating to selection and notification of a potential winner, if applicable, shall be applied, with the necessary amendments, until a qualified winner has been duly selected. 8. By entering this Contest the entrants automatically agree to accept and abide by these Official Rules. All entries and entrants are subject to verification. All entries are automatically void if not obtained or submitted through legitimate channels, or if altered, forged, defaced, mutilated, tampered with or irregular in any way. An entrant is not a winner unless and until entrant’s eligibility and correct answer to the skill-testing question has been verified. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest, and Contest Sponsors will not accept any evidence of winning in lieu of its own validation process. 9. All entries become property of Contest Sponsors who assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting the name of the prize winner (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest including canceling any method of entry, and select a winner from previously received eligible entries. Contest Sponsors reserve their right to modify the Rules without notice without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any person they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Use of any automated system to participate is prohibited and will result in disqualification. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to any person’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable. 10. In the event of a dispute as to the identity of a selected entrant based on an e-mail address, entries received on-line shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 11. Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by Contest Sponsors for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions of a Contest Sponsor by mail or e-mail. Entrants are able to opt in with respect to receiving such marketing information online. . Contest winners consent to the transfer of their personal information by Contest Sponsors and/or a designated third party administrator in conjunction with executing the terms of this Contest as described in these Official Rules. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Dell Canada Inc.’s Privacy policy at http://www1.ca.dell.com/content/topics/reftopic.aspx/gen/en/policy?c=ca&l=en&s=gen&~section=000 and The Globe and Mail’s Privacy policy at http://www.theglobeandmail.com/help/privacy/. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. 11. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. |
